This September 2nd update expands Nintendo's enforcement capabilities beyond DMCA takedowns, allowing them to proactively remove content and restrict creators from sharing future Nintendo-related material.
Previously, Nintendo focused on content deemed "unlawful, infringing, or inappropriate." The new guidelines clarify this, adding specific examples of prohibited content: actions disrupting multiplayer gameplay and content considered graphic, explicit, harmful, or offensive.
This stricter approach is speculated to be a response to incidents like the takedown of a Splatoon 3 video by Liora Channel. This video, featuring interviews with female players discussing dating experiences within the game, was deemed unacceptable by Nintendo. Liora Channel subsequently pledged to avoid sexually suggestive Nintendo-related content.
The increased scrutiny reflects concerns about predatory behavior in online gaming, particularly impacting younger players. Nintendo aims to prevent its games from being associated with harmful activities, citing examples of abuse in platforms like Roblox. The influence of content creators necessitates this proactive approach to safeguarding young players.
